Case alert: ForUM and Friends of the Earth Norway vs Cermaq ASA

Cermaq ASA, a Norwegian fish farming and fish feed company, is involved the production of fish feed and the processing of by-products from the fish farming. The company also engages in the breeding and distribution of salmon and trout. The company owns and operates hatcheries and fresh water sites in Canada and Chile. The Norwegian government is the majority shareholder of the company.

The complaint against Cermaq ASA is lodged for the breach of the OECD Guidelines concerning production sustainability, employment conditions and human rights. The conditions for which the complaint is lodged apply particularly to its subsidiary Mainstream’s fish farming activity. The Complainants maintain that the company has breached the OECD Guidelines’ general policies by not taking adequate consideration of the rights of indigenous people’s in Canada and Chile who experience that Cermaq’s salmon breeding activities threaten their access to resources. The Complainants maintain Cermaq also breaches the OECD guidelines’ article 2.7 through inadequate routines for contact and dispute arbitration with other interested parties in the areas they have activities.The Complainants further maintain Cermaq has breached the OECD Guidelines employment provisions through unfounded dismissals, attempts to prevent free organising of employees to join labour unions, discrimination against women and inadequate safety routines for its employees. Cermaq’s activities would also pose an environmental threat through the spread of salmon lice and disease originating from its fish farms.
