Allégations
On 22 December 2020, Nitta Gelatin India Limited Action Council and Jananeethi filed a specific instance against Nitta Gelatin Inc. at the Japanese NCP. The complaint concerns activities of Nitta Gelatin Inc, through its subsidiary Nitta Gelatin India Limited (NGIL), in Kathikudam, Kerala, India in relation to the environmental and human rights impacts of NGIL’s gelatin production operations. The complainants allege that NGIL’s operations have resulted in deterioration of public health and severe contamination of the Chalakudy River, which is the primary source of drinking and agricultural water for people residing near the river. The complainants are seeking mediation from the Japanese NCP that results in an acknowledgement of the impact of NGIL’s operations on the environment and local community; ensures that Nitta Gelatin Inc and NGIL provide compensation to people affected as a result of NGIL’s operations; and an assurance from Nitta Gelatin Inc that its Indian arm NGIL will comply with the directions set out by the National Green Tribunal in India as per its 2017 order.

On 27 December 2023, the Japanese NCP finalised its initial assessment in which the NCP partially accepted the complaint.
In August 2024, Nitta Gelatin Inc and NGIL declined the Japanese NCP’s offer of good offices. The Japanese NCP indicated that it would proceed to issue the final statement.
On 29 June 2026, the Japanese NCP issued its Final Statement, terminating the proceedings since it was “unable to confirm the willingness of both parties to this specific instance to participate in mediation under the conditions proposed by the Japanese NCP”. It stated that the companies had declined mediation as they “intended to pursue an appropriate resolution of the specific instance in good faith through judicial procedures in India under the Indian laws and regulations, which makes it difficult to resolve the specific instance through mediation of the Japanese NCP”.
The NCP recommended that the companies “continue to ensure observance of the Guidelines and implementation of due diligence, taking into account the impact on the environment and local communities, and, whilst noting that there is a difference of opinion between the Complainants and the Enterprises Involved, to make efforts to engage with the local community, including the Complainants”.
